PRIVACY AND PERSONAL DATA PROTECTION POLICY

The website https://www.mvptrans.gr , for brevity called site, is managed by Company “MARIOS PANAGOS - VICTORIA TOPTSIAN TRANSPORT S.A.”, with trading name “MVP INTERNATIONAL TRANSPORT S.A.” (104 El. Venizelou St., Kallithea, Attica, postal code 176 76, vat 999941814), for brevity called MVP; the site’s content and purpose is to present the full gamut of services we provide as intermediaries in freight, tax clearance and the storage of goods, as well as to enable communication through the site’s e-mail page.

Personal data, i.e. any information that can or may identify you individually directly or indirectly which you submit on a voluntary or mandatory basis when you enter the site or register an e-mail address, and any additional personal information as may be required of you at later times, is collected, processed, transmitted, stored and used by us in the capacity of data controllers, and also by service providers, including the data controllers of said service providers.

In ΜVP we feel very strongly about the protection of your privacy and personal data and have put in place all necessary measures to ensure the security and confidentiality of site visitor/user data. Please read the present Privacy Notice carefully in order to learn which data are collected from you when you visit the site, the posted data, their use and your rights. Said terms may be improved, updated or otherwise amended at any time in whole or in part.

This Policy, and any specific terms on data processing as may be agreed in the context of each co-operation or transaction, are governed by the provisions of EU Regulation 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the Processing of Personal Data and the free movement of such data and repealing Directive 95/46/EC (GDPR), Act 4624/2019 (Data Protection Authority, implementing measures of GDPR), Act 3471/2006 (Protection of Personal Data and Privacy in electronic communications and amendment of Act 2472/1997), as may be effective, as well as the relevant decisions of the responsible officials and authorities.

1. Which personal data we collect and how.

Our site is about providing information regarding our services and does not require visitors/users to provide/submit personal data. However, when you visit or browse the site, certain information that can identify you directly or indirectly may be collected automatically, such as:

  • the type of browser software and operating system,
  • the websites you visited right before and after your visit,
  •  the speed of connection and information about the software programs installed in your computer,

We also use CCTV and security cameras in order to be able to safeguard physical persons, the materials placed in our facilities and our installations in accordance with article 6 par. 1 of the GDPR.

Promotion activities. 

In the context of your previous co-operation or transaction with MVP and after your express consent, we may from time to time send to the e-mail address you submitted to us or call you or send text messages to your phone to apprise you of professional news. By using the present site and without prejudice to any law provisions about consent in electronic communications for direct marketing purposes, you expressly consent to all foregoing instances of processing in respect of your personal data. In case you do not wish or no longer wish to receive such news at any moment in time, please let us know immediately at support@mvptrans.gr . Your are free to revoke your consent at any time.

For statistical analysis:

In order to learn more about how visitors use the site we keep and analyze the collected data in summarized form. We may use this information, for instance, to monitor and analyze the use of the site, enhance its functionality and better arrange and design content to respond to the needs of our visitors.

3. Legal basis of data processing.

The legal basis of data processing is directly contingent on the intended purpose. When your data are collected for the purpose of providing services, the legality of processing is assessed in light of contract performance. The collection of identification data is necessary to comply with our legal obligations. Processing your data for promotional purposes is based on your consent. At the same time, depending on the nature of processing, it may also rely on other legal bases under article 6 of the GDPR (e.g. our legitimate interests).

4. How we share your personal data and with whom.

We respect your right to have your privacy and personal information protected; therefore, we use this information only for the aforementioned purposes. We do not disclose, transmit or make your information accessible to third parties. To provide our services, we share data with our partners, employees or agents, in general, by way of physical paper records or digitally through security access codes. If required in order to carry out a transaction or perform a contract, your data are transmitted to other countries of the European Economic Area or countries that meet legal requirements and warranties or by concluding separate agreements that ensure an appropriate level of data security (conclusion of Model Contract Clauses).

We may have to provide personal data to state agencies or/and Judicial or Independent Authorities to comply with legal obligations or court orders.

  • We may disclose aggregated data or data that do not identify you directly to third parties in order to develop content and services on our site. We do not in any manner whatsoever disclose your contact details to third parties.
  • We may use third parties at present or in the future to provide services associated with the site such as database management, maintenance, analytics, data processing or distribution of e-mails or text messages. Said third parties will have access to information related to you only to the extent required for the execution of the foregoing tasks on our behalf and with express contractual commitments regarding the protection of your privacy and personal data.

a. in case of acquisition of MVP by a third party or merger with another company or similar business transaction. In such event, however, our site will inform you by displaying a prominent notice or send relevant information to the e-mail address you have provided us prior to the transfer of your data or to the implementation of a different privacy and personal data protection policy in general.

b. in order to investigate, avert or take steps in respect of illegal activities, in case of suspected unlawful conduct or punishable offenses violating the rights or legitimate interests of any physical person or legal entity, in case of violation of our site’s Terms of Use or if required to do so by law, as well as on such other occasions as we may consider in good faith that the disclosure of such information is necessary,

In case you provide personal data pertaining to third parties to us, you warrant that you have informed said parties about the purposes and the manner in which we have to process their personal data.

5. Links to other websites.

The articles and messages displayed on our site contain links to other websites. The above information on the protection of personal data applies solely to our site. Please pay attention to the relevant sections on the protection of personal data in linked websites. We assume no liability for and do not endorse any content of third party websites accessed through Links or displayed in special ways. All liability for unlawful, defective or incomplete content on linked websites or for such damage as may be incurred from use or failure to use any information contained therein, lies solely with the providers of said content.

6. Duration of personal data retention.

MVP keeps the personal data it collects only for such time as is strictly necessary to achieve the foregoing processing purposes or to comply with applicable law or with restriction agreements or the terms of the present Policy. Personal information collected automatically is kept for a period up to 12 months after which it may be stored in unidentifiable summarized form. Your personal data collected through CCTV and security cameras are kept for 37 days. In case you revoke your consent to the collection and processing of your personal data, we shall erase your data from our digital and physical records unless keeping such records is required to comply with legal obligations or to exercise, substantiate or defend our rights or legitimate interests at the courts.

When data processing is mandatory by virtue of the applicable statutory framework, your personal data will be kept for as long as the relevant provisions stipulate.

When data are processed by virtue of contract, your personal data will be stored for as long as required to perform the contract or to substantiate, exercise or/and support any legal claims arising from the contract.

When data are processed in order to respond to a request submitted by you, we will process your data for the length of time necessary to satisfy your request.

When data are processed in the context of promotion or marketing activities, we will be processing your data until such time as you revoke your consent and ask that you no longer receive advertising messages from us.

7. Data security.

We are fully committed to the security of your personal data. You may rest assured that all appropriate technical and organizational measures are put in place to ensure data security, confidentiality of processing and protection from any accidental or illicit corruption/loss/alteration, unauthorized transmission or access or any other form of undue processing, and from unauthorized or unlawful access or processing, and that said measures are reviewed at regular intervals for their responsiveness and appropriateness. Although we use our best efforts to protect your personal data, given that the transmission of data on the internet can never be totally safe, we cannot guarantee the security of data transmitted through the websites of our suppliers, partners or agents in general.

We bear no liability for any modalities of personal data protection put in place by third parties or for content or security provided by third parties, despite the conclusion of written agreements.

Your data security also depends on you. We use our best endeavours to ensure the safe use of our site and applications as far as possible. We recommend that you absolutely refrain from disclosing any confidential information when using e-mail. For your own protection, our reply e-mails to you will not contain any confidential information.

  • the right of access, ask to review your personal data subjected to processing by us or on our behalf in order to learn which data we process, for what purposes and their recipients,
  • the right to rectification, rectify discrepancies or inaccuracies in respect of your data,
  • the right of erasure (right to be forgotten), have your personal data erased from our records provided, however, that processing is no longer necessary or the retention of your data is no longer required in order for us to comply with legal obligations or to defend our legal interests at court,
  • the right to restrict processing, in case the accuracy of your data is in doubt,
  • the right to portability, receive your data in a structured and commonly used format,
  • the right to object, in case you do not wish that your data be used for direct commercial promotion of our services.

We will use our best efforts to respond to all relevant requests within thirty days as from the reception thereof. However, if due to the complexity of your request or the volume of data it is not possible to satisfy your request within thirty days, we pledge to inform you in writing within the afore deadline of the reasons for the delay and use our best endeavours to satisfy your request as soon as possible and, at any rate, within two additional months.

MVP reserves the right to deny your request if it considers it to be blatantly unfounded or extravagant and will inform you of the reasons for refusal. At all events, you may lodge a complaint about the exercise of your rights with the Data Protection Authority (www.dpa.gr).

Our site visitors should consult our Privacy and Personal Data Policy regularly to be aware of any changes and we promise to keep visitors and users up to date, as required, by any appropriate means, in compliance with the requirements of effective legislation and the relevant decisions by responsible authorities and officials. The Courts of Athens have exclusive jurisdiction over any disputes that may arise from the present terms or the construction thereof by express prorogation of all other jurisdictions.
